DOUG CARTER: We love to go to trial. But just like a good surgeon who enjoys his job, you do surgery when necessary. And the same is true when you're a trial lawyer such as myself.
I have fun when we go to trial. I enjoy it. But I do not wish a trial on a client because for clients it is always other than a difficult experience.
The fact is that in civil cases, ours and with other firms as well, over 90% of the cases that are filed do settle. So what is it that makes it different about us? We get cases ready for trial. And that matters. It is the fact that a case is ready for trial that the defendant and its insurance carrier understands, means that they have to do the right thing and make a fair settlement.
